BIR Press Release on Director-National Artist Caparas in Tax Evasion

An October 21, 2010 press release prepared by the Bureau of Internal Revenue

Controversial Director-National Artist Calro J. Caparas is now facing sixty-four (64) counts of criminal charges for violating the Tax Code after the Bureau of Internal Revenue (BIR) filed today a complaint against him with the Department of Justice for his failure to file various tax returns for taxable years 2006, 2007, 2008, and 2009.

The investigation of Caparas, known for directing/ producing the movie, “The Maggie de la Rivera Story” and GMA-7 television shows like “Gagambino”, “Panday”, and “Totoy Bato,” was triggered by a television news report on the planned cancellation of two (2) television shows (“Ang Pangarap Kong Jackpot” and “Kroko”) featuring lottery winners. The two shows were reportedly part of a P1.3 billion contract between the Philippine Charity Sweepstakes Office (PCSO) and Caparas, as producer of the shows.
Records of investigation show that Caparas is a resident of No. 207 San Jose St., Ayala Alabang Village, Muntinlupa. He is a registered taxpayer of Revenue District No. 41, Mandaluyong City as a “Professional” engaged in dramatic arts, among others.
BIR investigators discovered that Caparas received from PCSO P850,951,388.60 as payments for the production of different television programs during 2006 to 2009.
As an individual receiving self-employment income, Caparas is required to file a declaration of such income and pay the taxes due thereon which he failed to do in the taxable years in question. Investigation by the BIR disclosed that he failed to file his Income Tax Return and VAT returns for 2006, 2007, 2008, and 2009 and thus failed to pay the taxes due thereon.
Total tax due from Caparas for the four-year period is P540,210,206.89 inclusive of surcharges and penalties, broken down as follows: Income tax- P344,210,206.89; and VAT- P195,613,874.93.
The case against Carlo J. Caparas is the twelfth (12th) filed under the RATE program of the BIR under the leadership of Commissioner Kim S. Jacinto-Henares.
